Pool Safety Laws Port Douglas

The pool safety laws in Port Douglas are the same as those across Queensland and have been implemented to reduce the risk of drowning for children under five years of age. It’s overseen by the Queensland Building and Construction Commission (QBCC) and is enforceable with fines and penalties. The pool safety laws Port Douglas apply to all pools, associated with buildings. This includes, but is not limited to, houses, townhouses, units, motels, hotels, resorts, backpacker hostels and caravan parks.

For your reference, a swimming pool is defined as an excavation or structure which can be filled with water to a depth of 300mm or more. This applies to pools (above ground and inground), spa tubs and spa pools. The new laws were introduced in 2009 and as of November 2015, it was a requirement that all pool owners ensured they were compliant.

What are the pool safety laws in Port Douglas & does your pool comply?

The Queensland, Port Douglas pool safety laws are about barriers, fences and gates. The law requires all pool owners to be compliant, regardless of when their pool was installed. The facts are quite comprehensive and very specific. We’re pleased to provide an overview below, but please note there are more requirements and these can be seen on the Queensland Building and Construction Commission website.

The minimum height of fences surrounding a pool must be 1200mm, from ground level to the top, with no more than a 100mm gap between the bottom of the fence and the ground. If your fence is less than 1800mm high, the climbable objects must be at least 900mm away from the pool. Gates must be self-closing and self-latching from all positions. Latches must be appropriately positioned, out of reach of small children. There can be no direct access to the pool area, through a door, house, or other part of a building.

The Douglas Shire Council can investigate compliance issues, regarding pool safety standards. If you are found to be non-compliant you can be issued with on the spot fines of $934 for individuals and $2669 for companies.
